TourBoxTech (hereinafter referred to as "we," "our," or "TourBox") understands the importance of your personal information and is committed to protecting its security and integrity. This Privacy Policy explains how we collect, use, store, share, and safeguard your personal information when you use our products, services, websites, and mobile applications, as well as how you may exercise your corresponding rights.

This Policy applies to all products and services provided by TourBoxTech, including but not limited to TourBox hardware devices, the TourBox Console software, our official website, and related online services.

By using any TourBox account, services, websites, applications, products, software, hardware or other customer-facing offerings or items, whether tangible or intangible (all, collectively, "TourBox Products and Services"), you acknowledge and consent to the data practices described in this Privacy Policy. If you do not agree with the practices described in this Privacy Policy, you should not use TourBox Products and Services. If you or your employer has a separate agreement with TourBox, the terms of such agreement may supersede this Privacy Policy.

Please read this Privacy Policy carefully before using any TourBox Products and Services. By using any TourBox Products and Services, you acknowledge that you fully understand and agree to this Privacy Policy.

2. How We Collect and Use Your Personal Information.

"Personal Information" refers to any and all kinds or types of information, recorded electronically or otherwise, that are related to an identified or identifiable natural person. We collect and use your Personal Information only for the purposes described in this Privacy Policy, and in accordance with the principles of legality, legitimacy, necessity, and good faith.

(A) Information Necessary for Core Functions

Account Registration and Login: When you create a TourBox account or otherwise access TourBox Products and Services, we may collect your email address and/or the password you set. You may also choose to provide a profile picture or nickname to complete your profile. Some services may support login via third-party accounts (e.g., Google, Apple ID). In such cases, we will obtain the Personal Information necessary to complete authentication (such as an OpenID) from the third party, in order to associate with your TourBox account.

Device Connection and Functionality: To ensure that TourBox hardware devices communicate properly with the TourBox console software (the "Console") and also provide essential control features, we will or may collect and process:

  • Device Information: Device model, firmware version, serial number, Bluetooth identifiers.
  • Configuration & Usage Data: Your customized mapping presets for buttons, knobs, dials, scroll wheels and trackballs; your software settings within the Console; basic connection and interaction logs (e.g., connection/disconnection time) used for functional stability, diagnostics, and feature execution.
  • Software State Information: To support advanced features within certain TourBox Products and Services, including without limitation Smart Preset Switching, the Console may need to identify the creative software you are using (e.g., Adobe Photoshop, DaVinci Resolve), as well as its workspace state, in order to automatically apply corresponding presets. This process is primarily executed locally on your device. We do not continuously upload such information for identification purposes.

Online Store Services: When purchasing any TourBox Products and Services or requesting after-sales service and support through our official website, we collect your name, phone number, email address, and shipping address for order fulfillment, product delivery, and technical support. Payment processing is handled by third-party platforms, and we do not collect or store card numbers or financial information.

(B) Service Improvement (With Your Consent)

Customer Support & Communication: When you contact our customer support team, we may retain your contact information, communication records, and any additional information you provide, including without limitation in order to resolve your issues and improve service quality.

(C)General Information Collection.

If you choose to sign up for our newsletter, email updates or other information subscriptions, or when you express an interest in receiving additional information about any of the TourBox Products and Services, we will collect the Personal Information you voluntarily provide to us for such purposes, including as follows:

  • If you complete a web form, requesting that we contact you, we collect personal contact information, such as name, company name, address, job title, phone number and email address ("Contact Information").
  • If you register for, or attend an event or webinar organized or sponsored by us, we will collect the information needed to register you for such event or webinar.
  • Subject to your explicit consent, if you download an electronic-book, research paper, pamphlet, information update or other content from our website, we may collect certain Contact Information from you so we can provide you with additional information about TourBox Products and Services.
  • If you choose to sign up for a contest or sweepstakes that we sponsor, we will collect Contact Information for the purpose of carrying out the giveaway.
  • If you visit our offices, we will collect some Contact Information about you for building security purposes.

(D) Information Processing Uses and Limitations.

We will use the information we collect for the purposes described in this Privacy Policy. If we collect your Personal Information, we will process it only to the extent necessary for our legitimate interests (including without limitation the provision and delivery of TourBox Products and Services) and only for the purposes for which the Personal Information was provided, including to:

  • Administer, monitor and improve the TourBox Products and Services.
  • Conduct direct marketing practices via marketing communications and assist with our promotional and marketing efforts.
  • Ensure the security of the TourBox Products and Services by tracking their use, creating aggregated non-personal data, investigating suspicious activity, and enforcing our terms and policies.
  • Manage customer relationships.
  • Perform and deliver TourBox Products and Services. For example, if you sign up for a newsletter or interact with a TourBox website or portal, we may use the Contact Information you provide to send you a newsletter or other email communications.
  • Provide the TourBox Products and Services to which you purchased, ordered, licensed and/or subscribed. In this respect, when a customer chooses to provide Personal Information to TourBox via the TourBox Products and Services, we will process that data in accordance with the customer's instructions (if any), and applicable law.
  • Comply with legal obligations and to cooperate with public and government authorities, courts and regulators in accordance with applicable laws, to the extent that doing so requires the processing of your or other Personal Information.
  • Comply with judicial proceedings, court orders, respond to lawful requests and for auditing purposes.
  • Aggregate and anonymize (de-identify) Personal Information that does not identify you or any other specific individual.

(E) Exceptions Permitted by Law

You acknowledge that under the following circumstances, we may collect or use your personal information without your consent:

  • When necessary to enter into or perform a contract to which you are a party;
  • When required for fulfilling statutory duties or obligations;
  • When necessary to respond to public health emergencies or protect life, health, or property;
  • When handling personal information for news reporting or public supervision within a reasonable scope;
  • When processing information that you or another party has lawfully disclosed; and
  • Other circumstances permitted by applicable laws and regulations.

3. How We Use Cookies and Similar Technologies

To ensure proper website functionality and optimize your browsing experience, we store small data files called Cookies on your computer or mobile device. Cookies typically contain identifiers, site names, and certain numbers or characters. Cookies help websites remember your preferences (e.g., language settings) and understand how you use the site.

You may manage or delete Cookies through your browser settings. However, disabling Cookies may affect certain interactive features of our site.

4. How We Share, Transfer, and Disclose Your Personal Information

We value your privacy and will not share your personal information with any company, organization, or individual outside of TourBox and its affiliates, except in the following situations:

(A) Sharing

  • With Your Explicit Consent
  • With Our Affiliates, Parents and Subsidiaries: We may share necessary personal information with our affiliated companies, parents and/or subsidiaries (any, "Affiliates"), for the purposes stated in this Privacy Policy. If Affiliates change their processing purposes, they will seek your additional consent.
  • With Authorized Third-Party Partners/Subcontractors/Vendors: We may share necessary information with subcontractors, vendors, service providers, agents, contractors, or others who perform functions for TourBox or on our behalf, including without limitation as necessary to properly perform and deliver TourBox Products and Services. For example, we may contract such parties to provide certain services to assist in the development and improvement of the TourBox Products and Services, including without limitation for hosting and maintenance services, data storage and management, and marketing and promotional activities.
  • Third-Party SDKs: Our applications may integrate third-party SDKs for analytics, crash monitoring, etc. These SDKs may collect anonymous device information (e.g., model, OS version) and usage data. We conduct strict security assessments and recommend reviewing their privacy policies.

(B) Legal or Regulatory Requirements

We may disclose your information when required by applicable laws, legal procedures, litigation, or government authorities.

(C) Corporate Changes

In the event of a merger, acquisition, sale or corporate change of control of TourBox, or in the event of the sale and transfer of all or substantially all of TourBox's assets, to then extent necessary in connection with such transaction, or in the event of a bankruptcy liquidation, in each case or instance involving the transfer of Personal Information, we will take all commercially reasonable steps to require the new entity to continue complying with this Privacy Policy, or to seek your renewed consent.

(D) Social Media Partners

We may share your Personal Information with our social media and analytics partners, who may combine the Personal Information collected from you with other information that they've collected for behavioral or other insights.

Please note that in some of the circumstances above, we may share aggregated and anonymized (de-identified) Personal Information that does not identify you or any other specific individual.

5. How We Protect Your Personal Information

(A) Technical Measures

We implement industry-standard security safeguards to prevent unauthorized access, disclosure, use, modification, damage, or loss of data.

(B) Retention

We retain your personal information only for the period necessary to fulfill the purposes described in this Policy, unless a longer retention period is required by law.

(C) Administrative Measures

We maintain dedicated data security policies, apply strict access controls, and ensure confidentiality obligations for employees and agents who may access your information.

(D) Security Incident Response

Although we take reasonable protective measures, the internet environment is not absolutely secure. In case of a data breach, we will notify you of the incident, its potential impact, the remedial measures taken, and report to regulators as required by law.

(E) Your Responsibility

Your account credentials—especially your password—are crucial to safeguarding your information. Please use strong passwords and protect your login details.

(F) Acknowledgement of Limitations

TourBox recognizes the importance of safeguarding your Personal Information. Accordingly, we use security technologies and procedures to help protect your Personal Information from unauthorized access, use or disclosure. However, by providing us with Personal Information, you acknowledge and agree that no data transmission over the internet or other network is guaranteed to be fully secure. As a result, you acknowledge and agree that any Personal Information you provide to us is provided at your own risk.

6. Your Rights

Under applicable data protection laws, you have the following rights regarding your personal information:

(A) Right to Access

You may request access to your personal information and inquire how it is used. You may also request a copy of your personal data.

(B) Right to Rectification

If your information is inaccurate or incomplete, you may request corrections.

(C) Right to Erasure

You may request that we permanently delete your personal data, subject to applicable legal requirements for retaining certain data.

(D) Right to Withdraw Consent

For processing activities based on your consent, you may withdraw consent at any time. Withdrawal does not affect prior processing conducted based on valid consent.

(E) Right to Opt Out of Certain Processing

The right to: (a) opt out of the processing of your Personal Information for purposes of targeted advertising, (b) opt out of the sale or sharing of your Personal Information; (c) limit the use of your sensitive Personal Information (if applicable), and (d) opt out of profiling in furtherance of decisions that produce legal or similarly significant effects.

(F) Right to Object to/Restrict Processing

The right to object or restrict us from processing your Personal Information in certain circumstances.

(G) Right to Notification of Automated Decision-Making

The right to know when you are subject to automated decision-making, the Personal Information used to render the decision, the principal factors and parameters involved in the decision, and human review or correction of the decision (or its underlying data, where appropriate). You may also have the right to consent or opt out of this automated decision-making, depending on your location and available TourBox functionalities.

7. How to Exercise Your Rights

For security purposes, you may be required to submit a written request or otherwise verify your identity. We will respond in accordance with applicable laws. If you are dissatisfied with our response, you may lodge a complaint with your local data protection authority or other regulatory agency. We encourage you to first reach out to us, so we have an opportunity to address your concerns directly, before you do so.

You will not be discriminated against in any way by virtue of your exercise of the rights listed in this Notice. However, should you withdraw your consent or object to processing of your Personal Information, or if you choose not to provide certain Personal Information, we may be unable to provide some, or all, of our TourBox Products and Services to you.

Only you, or an authorized agent that you authorize to act on your behalf, may make a request related to your Personal Information. We must verify your identity before fulfilling your requests, and if we cannot verify your identity, we may request additional information from you. If you are an authorized agent making a request on behalf of another person, we will also need to verify your identity, which may require proof of your written authorization or evidence of a power of attorney. We endeavor to respond to requests within the time period required by applicable law. If we require more time, we will inform you of the reason and extension period in writing.

We do not charge a fee to process or respond to your requests unless they are excessive or repetitive. If we determine that a request warrants a fee, we will tell you why we made that decision and provide you with a cost estimate before completing your request. We may deny certain requests, or only fulfill some in part, as permitted or required by law. If you are not satisfied with the resolution of your request and you are afforded a right to appeal such decision, you will be notified of our appeal process in our response to your request.

8. The General Data and Protection Regulation

In the event we collect Personal Data (as defined in the General Data Protection Regulation (the "GDPR")) that is subject to the GDPR, this Section will apply. Personal Data will be subject to the GDPR if it relates to a Data Subject (as defined in GDPR) located in the European Union (the "EU").

Terms in this section are meant to be understood in a manner consistent with the GDPR. Such terms may have a different definition or meaning in other portions of this Privacy Policy, as the GDPR may not apply to those sections.

If you, as our customer, are required under the GDPR or any applicable EU legislation to enter into a contract with your data processors, you are requested to contact your TourBox business contact, and we will send you a copy of our Data Processing Addendum.

TourBox will take commercially reasonable is responsible for ensuring that, if and when TourBox is a controller of Personal Data, it shall be retained only for as long as is necessary to accomplish the legitimate business purposes disclosed to you and for any compatible purposes, including without limitation the provision of TourBox Products and Services. We will cooperate with reasonable requests, and in accordance with applicable law, for assistance and efforts in meeting these obligations.

9. International Transfer of Information

TourBox does, or may, have global operations. Therefore, we may transfer and access Personal Information from around the world. To the extent any Personal Data of individuals based in the EU/EEA is provided by you or by a customer to any of TourBox's entities, offices, servers or databases based in the EU, and transferred to any of TourBox's entities outside of the EU/EEA or to any other recipient outside the EU/EEA, we will conduct the transfer in compliance with the GDPR by ensuring that an adequate level of protection is given to that Personal Data and that adequate technological and organizational safeguards are in place to protect the same.

10. The California Consumer Privacy Act

In the event we collect Personal Information that is subject to the California Consumer Privacy Act ("CCPA") in our capacity as a "business" covered by the CCPA, this section will apply (with the exception of any Personal Information collected from employees and/or job candidates which is separately addressed in any applicable employee privacy policy and/or candidate privacy policy.

Terms in this section are meant to be understood in a manner consistent with the CCPA; such terms may have different definitions or meanings in other portions of this Privacy Policy, as the CCPA may not apply to those sections.

When you exercise your rights under the CCPA, including requests to access, correct, or delete Personal Information, we have an obligation to verify your identity by matching the identifying information provided by you to the Personal Information maintained by TourBox.

The CCPA requires that we detail the categories of Personal Information that we collect. As applicable to the CCPA, we do or may collect the following categories of Personal Information:

  • Personal contact details, including without limitation identifiers such as real name, alias/nickname, postal addresses, unique personal identifiers, online identifiers, email address, phone number, company or account name, address and job title.
  • Personal information categories listed in the California Customer Records statute, including without limitation name, email, mobile telephone number, employment, credit card number, debit card number, or any other financial information.
  • Commercial Information, including without limitation records of TourBox Products and Services purchased, obtained or considered, or other purchasing or consuming histories or tendencies.
  • Internet or other similar network activity information, including without limitation your device's IP address, Cookies information, pages visited, browser language, and browser type. We use the information gathered via Cookies to analyze traffic and marketing program performance. Information collected from third parties is used to help us gather and analyze information about areas visited, and to evaluate and improve user experience. These third parties may use cookies and other tracking technologies.
  • Sensitive Personal Information to provide the TourBox Products and Services (e.g., credentials such as user-names and passwords).

TourBox shares Personal Information as necessary for certain business purposes. This includes sharing Personal Information with Service Providers for hosting and maintenance services; customer relationship management; data management and storage, as well as marketing and promotional efforts. In addition, TourBox shares Personal Information as described elsewhere in this Privacy Policy.

TourBox does not use or disclose Sensitive Personal Information for reasons other than those set forth in the CCPA. Further, TourBox does not sell or share (as those terms are defined in the CCPA) Personal Information in exchange for any monetary consideration.

11. Protection of Children's Personal Information

TourBox Products and Services are intended for users with adequate capacity for civil conduct. TourBox Products and Services are not intended to, nor do they seek to receive information from, children under the age of 16.

Although local laws and customs may define children differently, we consider minors under the age of 16 to be children. The TourBox Console is not a product specifically designed for children. We do not actively identify users' ages and do not intentionally collect personal information from children.

If children's Personal Information is collected inadvertently, we will delete it upon discovery.

We encourage parents or guardians to supervise the use of devices by minors.

If you are a parent or guardian and have concerns about our data practices or discover that we may have processed a child's Personal Information, please contact us immediately using the contact information at the end of this Privacy Policy.

12. Processing and Storage of Information

As a globally operating company, TourBox may process your personal information on servers located outside your country or region. In such cases, we will ensure an adequate level of data security protection, through applicable contractual clauses by and between TourBox and its Affiliates, explicit consent, or other legally recognized safeguards.

TourBox retains Personal Information for only as long as is reasonably necessary to fulfill or in relation to the purposes for which we collected and processed such Personal Information, and as required for the purpose for which the Personal Information was provided to us (including without limitation processing and delivery of any TourBox Products and Services, or otherwise as required by applicable laws or regulations.

TourBox stores your Personal Information for different periods of time depending on the type of Personal Information. To determine the appropriate retention period for Personal Information, we consider a variety of factors, including the nature, sensitivity, and potential risk of unauthorized disclosure or use of the Personal Information, and what is necessary for the purpose of the processing and on the basis of applicable legal requirements - including without limitation relevant statutes of limitation.

In some cases, information might be deleted or retained automatically, based on specific retention periods, while other information might be retained for a certain length of time pursuant to a contract you or an Affiliate has with us. In addition, we might retain information for business practices based on our legitimate interest or legal purposes, such as network improvement, fraud prevention, record-keeping or enforcing our legal rights.

We are not responsible for the practices employed by any websites or services linked to or from any site, portal or platform associated with TourBox Products and Services, including the information or content contained within them. We encourage you to investigate and ask questions before disclosing Personal Information to third parties, since any Personal Information disclosed will be handled in accordance with the applicable third party's privacy policy.

In some cases, we may offer links to social media platforms (like Facebook, Instagram, Pinterest, X (formerly known as Twitter)) that enable you to easily connect with us or share information on social media. Any content you post via these social media pages is subject to any applicable terms of use, data security policy and/or privacy policy applicable to or for those platforms.

13. Updates to This Policy

We may revise this Policy from time to time in our discretion, including without limitation to reflect business changes or regulatory requirements. Updated versions will be published on this page.

For material changes, we will notify you through appropriate channels.

Continued use of any TourBox Products and Services after updates to this Privacy Policy constitutes your acceptance of the revised Privacy Policy.
